On November 16, the Supreme People's Procuratorate released the third batch of typical cases of complaints by procuratorial organs involving non-public economic charges. The report of the 20th CPC National Congress pointed out that we should unswervingly encourage, support and guide the development of the non-public economy. In recent years, the number of complaint cases involving non-public economic charges handled by procuratorial organs has increased. In order to better guide procuratorial organs at all levels to handle such cases and serve to ensure the sustainable and healthy development of non-public economy, the Supreme People's Procuratorate has prepared five typical cases in this batch. These typical cases involve criminal, civil, administrative and other types of litigation, including five cases, including a clothing company's application for changing the supervision of coercive measures according to law, a trade company's application for withdrawing the case, a silk company's application for not filing the case for supervision, Shi's application for administrative non litigation enforcement supervision, and a relative's application for civil support to sue small and micro enterprises for reconciliation. The reporter found that the handling of typical cases has the following characteristics: relying on the "green channel" of 12309 procuratorial service center's legal services for private enterprises, the procuratorial organ accepts enterprise related cases at the first time, and timely feeds back the progress of case handling to the petitioners; Through cross sectoral cooperation and linkage, improve the efficiency of case handling, comprehensively analyze, handle and grasp the judicial guarantee of non-public economic development; Strengthen traceability governance, help enterprises find out business risks and management deficiencies, create a good business environment for the development of private enterprises, and achieve good social effects. It is understood that since 2020, the Supreme People's Procuratorate has deployed special activities to clean up and supervise complaint cases involving non-public economy, and to assign and supervise the handling of 100 key complaint cases involving non-public economy. It has supervised the handling of various cases involving the protection of the rights and interests of non-public economic entities and the relief of rights received by the national procuratorial organs through letters, visits, Internet, electricity and other channels, so as to realize the positive role of focusing on driving the overall and improving the effect with quality.
